General Conditions of Use

Le but de ces Conditions Générales d’Utilisation (connues sous le nom de « CGU ») est de fournir des orientations juridiques sur les termes et conditions régissant la fourniture du Site et des Services par Destinations Gravel, ainsi que de définir les conditions d’accès et d’utilisation des Services par « l’Utilisateur ».
Ces CGU sont accessibles sur le site sous l’intitulé « CGU ».
Toute inscription ou utilisation du site implique l’acceptation sans réserve ni restriction de ces conditions par l’utilisateur. Lors de son inscription sur le site via le formulaire d’inscription, chaque utilisateur accepte expressément ces CGU en cochant la case précédant le texte suivant : « Je reconnais avoir lu et compris les CGU et je les accepte ».
En cas de non-acceptation des CGU stipulées dans ce contrat, l’Utilisateur doit renoncer à l’accès aux services proposés par le site.
www.destinations-gravel.com se réserve le droit de modifier unilatéralement le contenu de ces CGU à tout moment.
ARTICLE 1 : MENTIONS LÉGALES
La gestion et l’édition de la publication du site www.destinations-gravel.com sont assurées par Gintrand Kimberley, domiciliée à Angers.

ARTICLE 2: ACCÈS AU SITE
Le site Web est accessible de n’importe où, 7 jours sur 7, 24 heures sur 24, sauf en cas de force majeure, d’interruptions planifiées ou non planifiées, ou à des fins de maintenance.
En cas de modifications, d’interruptions ou de suspension du site Web, l’éditeur ne pourra être tenu responsable.

L’utilisateur non membre n’a pas accès aux services exclusifs réservés tels que la newsletter. Pour y accéder, il doit s’inscrire en remplissant le formulaire. En acceptant de s’inscrire pour les services exclusifs réservés, l’utilisateur membre s’engage à fournir des informations sincères et exactes concernant son état civil et ses coordonnées, en particulier son adresse e-mail.
Tout utilisateur membre régulièrement inscrit peut également demander la désinscription en envoyant un e-mail à destinationsgravel@gmail.com. Celle-ci sera effective dans un délai raisonnable.
Tout événement résultant d’un cas de force majeure entraînant un dysfonctionnement du site ou du serveur et donnant lieu à toute interruption ou modification en cas de maintenance, n’engage pas la responsabilité de www.destinations-gravel.com. Dans ces cas, l’utilisateur accepte de ne pas tenir l’éditeur responsable de toute interruption ou suspension du service, même sans préavis.
L’utilisateur a la possibilité de contacter le site par e-mail à l’adresse e-mail de l’éditeur communiquée à l’ARTICLE 1.
ARTICLE 3 : DATA COLLECTION

The personal data collected by the Publisher is not transmitted to any other company.
Use of your personal data:
By visiting the Site, the user grants the Publisher the right to use internally the personal data collected by the latter.

ARTICLE 4 – INTELLECTUAL PROPERTY
The user agrees to comply with French law regarding copyright and related rights, as well as with international treaties and agreements containing provisions on the protection of copyright and intellectual property rights.
It is specified that the content, overall architecture of the Site, and in particular, but not limited to, software, logos, layout, texts, animated or static images, sounds, know-how, slogans, drawings, graphics, and any other element composing the Site are the exclusive property of the Publisher.
The user specifically agrees to:

Any use, reproduction, dissemination, commercialization, or modification of all or part of the “Destinations Gravel” website without the express authorization of the Publisher is prohibited and may lead to legal actions and proceedings in accordance with the Intellectual Property Code and the Civil Code.
The same applies to databases appearing on the Site, which are protected by Articles L.341-1 and following of the Intellectual Property Code, and any extraction or substantial qualitative or quantitative reuse of which is punishable.
The trademark “Destinations-Gravel” is a registered trademark of the Publisher. Any reproduction, imitation, or use, in whole or in part, of this trademark without the express and prior authorization of the Publisher is strictly prohibited in accordance with Articles L.713-2 and following of the Intellectual Property Code.
Other distinctive signs, including trade names and domain names reproduced on the Site, are the property of the Publisher, and any reproduction without express authorization may constitute usurpation and engage the responsibility of its author under Article 1240 of the Civil Code.
ARTICLE 5: LIABILITY
The sources of the information disseminated on the site www.destinations-gravel.com are deemed reliable but the site does not guarantee that it is free from faults, errors or omissions. The provision of this data cannot be assimilated, in any way whatsoever, to specific advice (in particular advice on routes, mechanics, dietetics, medical, etc.). The Site cannot be held responsible for any damage, direct or indirect. The information and indications on the routes as well as the good addresses are likely to be modified or changed, the site www.destinations-gravel.com cannot be held responsible for these modifications or changes. The User therefore uses the Site at his own risk and the site gives no guarantee as to the suitability of the itineraries and advice to the User’s needs. Despite regular updates, the site www.destinations-gravel.com cannot be held responsible for the modification of the administrative and legal provisions occurring after publication. Similarly, the site cannot be held responsible for the use and interpretation of the information contained in this site.
The www.destinations-gravel.com site cannot be held responsible for any viruses that could infect the computer or any computer equipment of the Internet user, following use, access, or download from this site.
The site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.
ARTICLE 6 – EXTERNAL LINKS POLICY
The Publisher uses external links to make its Site interactive and cannot be held responsible for their content, errors in website addresses, or domain names mentioned therein. ARTICLE 8: APPLICABLE LAW AND COMPETENT JURISDICTION
